Terms and Conditions

1. GENERAL

These General Terms and Conditions constitute an integral component of the adventure contract or intermediary contract, governing the reciprocal obligations between Plan My Adventure (the adventure organiser or intermediary) and the adventurer or the contracting party seeking adventure services.

These terms are binding for both Plan My Adventure and the adventurer or the contracting party. If Plan My Adventure acts as an organiser for adventures organised by other entities, the specific terms of those adventures will be clearly marked, and the respective General Terms and Conditions of the responsible adventure organiser will apply.

Upon signing the adventure contract, voucher, confirmation of booking, or card payment agreement, the adventurer fully acknowledges and accepts these General Terms and Conditions, the adventure itinerary, and any specific adventure terms if applicable.

In cases where the terms of the adventure contract, itinerary, individual travel plan, or General Terms of Contract differ in defining terms, rights, and obligations, the hierarchical order is as follows: the contract, then the itinerary or individual travel plan, and finally, the General Terms and Conditions.

By signing the adventure contract, the adventurer confirms that, before entering into the contract, Plan My Adventure provided essential information about the sport and health formalities for the adventure destination, along with the time required for completing these formalities. Additionally, the adventurer acknowledges the offer of a comprehensive adventure insurance package.

All the adventures/Sport for individuals under the age of 18 requires parental consent or consent from legal representatives. This consent must be certified by a notary, diplomatic mission, or consular office. The parent or legal representative, as the travel contractor, affirms, through contract signature, that the other parent is aware of and explicitly agrees to the contract.

The adventurer, acting as the adventure contractor, guarantees the accuracy and truthfulness of all information provided to Plan My Adventure. If the adventure contractor is not the adventurer, they guarantee authorization to provide the adventurer’s personal data and accept all legal obligations arising from the contract and applicable regulations.

The adventure contract or intermediary contract becomes legally effective:
1. Upon written or electronic signature by the contracting parties.
2. By payment of the total contracted amount to Plan My Adventure until the agreed date or, if contracted, by paying part of the agreed price and submitting documentation ensuring payment of the balance up to the total price by the agreed date.

2. BOOKINGS AND PAYMENTS

Bookings and payments for our adventure services can be made through various channels, including email , whatsapp and telephone or directly at Plan My Adventure’s Website.

To validate a booking, the adventurer or adventure contractor must provide all mandatory personal data, confirming the booking and acknowledging these General Terms and Conditions or any specific adventure terms for the selected service.

Upon accepting the written offer, the adventurer or adventure contractor fully embraces these General Terms and Conditions, having thoroughly reviewed and understood them. A payment of at least 25% of the total price is required, unless otherwise specified in the contract or adventure itinerary. The remaining balance or documentation for an impending payment must be settled at least 05 days before the adventure commences.

Failure to pay the balance by the specified deadline renders the booking invalid, treating it as cancelled by the adventurer or travel contractor. In such cases, Plan My Adventure reserves the right to retain the advance payment made for the adventure.

For health insurance/life insurance , the adventurer or travel contractor is obligated to pay the total service cost at the time of booking.

Plan My Adventure offers various payment options, including payment to the agency’s bank account and the use of UPI, debit cards (Maestro and Visa) or credit cards (Visa, MasterCard, American Express). We aim to provide flexibility and convenience in ensuring a seamless adventure experience.

These terms are established to streamline the booking process, ensuring clarity and adherence to our shared commitments.

3. Order Placement and Cancellation

By placing an order with Plan My Adventure, you acknowledge that your order serves as an offer to purchase the listed products and services under the specified terms. Our acceptance of orders is at our discretion, and we reserve the right to decline any order. Upon receiving your order and payment, we will issue a confirmation email containing your order number and item details. The contract between Plan My Adventure and you will be established only upon your receipt of the order confirmation email. You retain the option to cancel your order, adhering to the cancellation terms outlined in Section 6 below.

4. Pricing and Payment Terms

Our prices at Plan My Adventure are subject to change without prior notice. The applicable price for a product or service will be the one in effect at the time of order placement, as detailed in your order confirmation email. Any price adjustments will only affect orders made following such modifications. Prices displayed do not encompass taxes or additional charges, which will be clearly specified in your shopping cart before payment and on the invoice.

Payment terms are at our discretion, and, unless otherwise agreed in writing, payment is due at the time of order placement on our website. Payments will be processed using a third-party payment gateway, and you will be directed to their site. Additional terms from the payment gateway provider may apply, and Plan My Adventure is not responsible for any claims related to your activities on their platform.

By engaging in transactions with us, you confirm:

(i) The accuracy and completeness of the financial information provided.
(ii) Your authorization to use the chosen payment method for the purchase.
(iii) Assurance that your bank or financial institution will honour incurred charges.
(iv) Commitment to paying charges at the posted prices, inclusive of applicable taxes, if any.

We prioritise transparency and accuracy, and any errors will be promptly addressed. Plan My Adventure reserves the right to cancel orders resulting from such errors.

5. Delivery

We will coordinate the delivery of products or services through our chosen third-party service providers or vendors to the location specified by us. Any payments to third-party service providers or vendors are at your own risk and are not considered part of the order placed on the Plan My Adventure site.

Delivery of products or services is subject to force majeure events, events beyond our reasonable control. While we take reasonable care in selecting service providers or vendors, you acknowledge that Plan My Adventure is not responsible for any acts or omissions regarding the safety, quality, or delays in such products or services, except for cases of gross negligence or willful misconduct on our part.

6. Cancellations and Refunds

Cancellation requests must be submitted in writing to contact@planmyadventures.com, including complete booking details and identification numbers. After placing an order, cancellation charges apply, as indicated on each product page at the time of booking. Refunds are processed within 7-10 business days of receiving your cancellation request in writing, credited back to the original payment method unless otherwise agreed in writing.

7. Limited Warranty

Plan My Adventure warrants reasonable verifications of third-party service providers or vendors and their on-ground services. Services will be performed professionally and in accordance with industry standards. Our responsibility for defective services is limited to re-performance or a reasonable refund. We disclaim all other warranties unless prohibited by law. Our aggregate liability is limited to the amounts paid by you at the time of booking or INR 1000, whichever is lower.

To obtain warranty service, contact contact@planmyadventures.com within twelve (12) hours of identifying any service deficiency.

8. Privacy

We respect your privacy, and our Privacy Policy at www.planmyadventure.com/privacy-policy/ governs the processing of personal data collected during product or service purchases.

9. Force Majeure

We are not liable for failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, governmental actions, war, terrorism, epidemics, strikes, or other unforeseen events.

These policies aim to ensure clarity, transparency, and a seamless adventure experience with Plan My Adventure.

10. Governing Law and Jurisdiction

All matters arising from these Terms and any transactions with Plan My Adventure are governed by and construed in accordance with the laws of India. Unless subject to arbitration, the courts in Jaipur shall exclusively have jurisdiction over all disputes arising from or connected to these Terms or your bookings with us.

11. Dispute Resolution and Binding Arbitration

Any Dispute, controversy, claims, or disagreements arising from these Terms or any transactions with you shall be exclusively referred to and resolved through arbitration as per the Arbitration and Conciliation Act, 1996. The arbitration, held in Jaipur, will consist of a sole arbitrator appointed by the Jaipur Centre for International Arbitration. You waive any objections to the arbitrator’s jurisdiction. The arbitrator’s decision, in English, will be final and binding.

12. Assignment

You may not assign your rights or delegate your obligations under these Terms without our prior written consent. Any unauthorised assignment or delegation is null and void, and it does not relieve you of your obligations under these Terms.

13. No Waivers

Our failure to enforce any right or provision in these Terms does not constitute a waiver of future enforcement of that right or provision. Waivers are effective only if in writing and signed by an authorised representative of Plan My Adventure.

14. No Third-Party Beneficiaries

These Terms do not confer rights or remedies upon any person other than you.

15. Notices

For notices to you, we may use your provided email address or post on the Site. It is your responsibility to keep your email address current. To give us notice, contact us at contact@planmyadventures.com or via mail at ‘Legal team, Plan My Adventure, [Full Address], India.’

16. Severability

If any provision of these Terms is deemed invalid, illegal, void, or unenforceable, it will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

17. Entire Agreement

Our order confirmation, these Terms, Website Terms of Use, and Privacy Policy collectively constitute the final and integrated agreement between you and Plan My Adventure.
